These Terms of Service ("Terms") govern your use of clarityarchitect.io and related pages (the "Site") and any coaching program, call, content, or resource provided by MDA Solutions, LLC ("Clarity Architect," "we," "us," or "our"). By using the Site, submitting an application, or booking a call, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Site or purchase our services.

2. Applications and Calls

Submitting an application does not guarantee acceptance into any program. We may accept or decline any application at our discretion. Calls booked through the Site are for evaluating fit and are not coaching, consulting, or professional advice.

3. Coaching Services

Our programs are business and personal-development coaching. The specific scope, length, deliverables, price, and payment schedule of any program are set out in the enrollment agreement or checkout page you accept at purchase ("Enrollment Agreement"). If the Enrollment Agreement conflicts with these Terms, the Enrollment Agreement controls.

Coaching is not therapy, medical, mental-health, legal, financial, tax, or investment advice. Our coaches are not acting as licensed therapists, physicians, attorneys, accountants, or financial advisors. References to focus, attention, ADHD, or similar topics are shared from personal and business experience and are not a diagnosis or treatment. Consult a qualified licensed professional for those needs. You are solely responsible for your decisions and their results.

4. Payments and Refunds

Program fees are due as stated in your Enrollment Agreement. If you choose a payment plan, you are responsible for all scheduled payments even if you stop participating. Refund requests made before the onboarding session are reviewed case by case."] Missed sessions that are not rescheduled with at least 24 hours' notice may be forfeited.

5. No Guarantee of Results

We do not guarantee any specific income, revenue, business, or personal outcome. Results depend on many factors outside our control, including your effort, experience, market, and circumstances. See our Earnings & Results Disclaimer below.

6. Intellectual Property

All content on the Site and in our programs, including videos, frameworks (such as the Identity OS), audits, worksheets, and recordings, is owned by us or our licensors and is protected by intellectual-property laws. You may use program materials for your own internal business use only. You may not copy, resell, distribute, record, or create derivative works from them without our written permission.

7. Confidentiality

We will keep information you share in coaching sessions confidential, except where disclosure is required by law or needed to prevent harm. Please keep other clients' information, if you come across it, confidential as well.

8. Communications

By providing your email or phone number, you agree that we may contact you about your application, calls, and our services, as described in our Privacy Policy. SMS messages are sent only with your consent; reply STOP to opt out.

9. Acceptable Use

You agree not to misuse the Site, including by attempting to access it without authorization, interfering with its operation, or submitting false information.

10. Third-Party Services

The Site uses third-party tools (for example, scheduling, video, and messaging platforms). We are not responsible for third-party services, and your use of them is subject to their terms.

11. Disclaimer of Warranties

The Site and services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our total liability for any claim relating to the Site or services will not exceed the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Site or services, your business decisions, or your violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of [Wyoming], without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [Wyoming], and you consent to their jurisdiction.

15. Changes

We may update these Terms from time to time. Continued use of the Site after changes means you accept the updated Terms.
